The Florida legislature recently enacted a new law substantially overhauling aspects of powers of attorney in Florida. A Florida Bar committee amalgamated aspects of existing law and portions of the Uniform Powers of Attorney Act to arrive at a significant clarification (and expansion) of the existing law. Although the new law becomes effective for powers of attorney executed on or after October 1, 2011, many of its provisions apply to powers signed before that date.
