Durable Power of Attorney Revised
Minor revisions were made to text in the Gifts and Suspension of Rights provisions. Also, two new questions were added asking for the name(s) and number of person(s) who may make the decision to obtain medical confirmation of an Agent's disability under paragraph (b) of the Suspension of Rights and Duties provision. Additional Law & Strategy has been added to the Amendment to Agent and Execution questions, including explaining the proper method for having a client sign the DPA. New Questions 1216 and 1217. Law & Strategy Questions 152, 1221-1223.
Medical Power of Attorney for Minor Child Revised
The Medical Power of Attorney form was revised since it will likely be subject to the provisions of the Florida Power of Attorney Act, effective October 1, 2011. Therefore, the list of things the attorney-in-fact is authorized to do under the document has been expanded. Three new questions have been added, including a new ‘short or long form’ question. The Short Form has some of the laundry list of authorities given to the attorney(s)-in-fact, and is presented in a more compact form. It will likely be sufficient (and less imposing) if the kids are staying with Grandma and Grandpa for the weekend. The longer form is more comprehensive and might be used for an extended absence, or if the parents are traveling to a dangerous place. New Questions 1259, 1265 and 1266.
